Deltacorp to take steps to address ₹6236cr tax shortfall notice faced by Deltatech Gaming

Deltatech Gaming Limited, a subsidiary of Deltacorp, has received an intimation for the payment of a significant tax shortfall under the CGST Act, 2017 and West Bengal GST Act, 2017. The notice, dated October 13, 2023, alleges a tax shortfall of 6236crfor the period from January 2018 to November 2022. Additionally, another tax shortfall of 14.75cr for the period from July 2017 to October 2022 has been intimated.

The notice instructs Deltatech Gaming Limited to make the alleged tax shortfall payment, including interest and penalties. Failure to comply may result in a show cause notice being issued to the Company under Section 74(1) of the CGST Act, 2017.

The tax demands are primarily based on the gross bet value of all games played during the relevant period. This approach, as opposed to gross rake amount, has been a subject of industry concern.

The Company and its subsidiary believe that the notice and tax demands are arbitrary and contrary to law. Legal remedies will be pursued to challenge these demands and related proceedings.
